SECTION 1 - Using Our Website To register with www.simply-hammocks.com and buy products from our site, you must be at least eighteen years old. You must ensure that all information you provide during registration or at any time is accurate and complete. If any of your details change, you must promptly update your personal information. It is essential that you provide us with your genuine name, address, phone number, email address, and any other necessary details to process your order.

SECTION 2 - Availability Our goods are subject to availability, and our acceptance of your offer to purchase them depends on their availability. Our confirmation of order acceptance through email or our website is not a guarantee of delivery. If we are unable to fulfill your order, we will notify you as soon as possible, and we will provide you with a full refund.

SECTION 3 - Non-Domestic Use We have curated our product line with the intention that they will only be used for domestic purposes. If you decide to utilize our products for business purposes, we exclude (to the fullest extent allowed by law) all warranties and conditions regarding their fitness for a specific purpose.


SECTION 4 - PRICING, DESCRIPTION & PRODUCT INFO

The prices you will pay for the products you order are listed on the website at the time of purchase (plus a delivery charge), unless we find an error in the price of the products you have ordered. In that case, we will notify you as soon as possible after receiving your order and provide you with the option to confirm your order at the correct price or cancel it. If we are unable to contact you, we will consider the order as cancelled. All prices are shown in US dollars.

While we take every reasonable effort to ensure that all product descriptions, details, and prices displayed on the website are accurate at the time they were entered into the system, the information displayed on the website may not reflect the exact status at the time you place your order.

Please note that the colors and appearance of our products may slightly differ from how they appear on your screen. We cannot guarantee that your monitor screen will display the exact color of the product upon delivery. All measurements and sizes are approximate, although we make every effort to ensure that they are as accurate as possible.

From time to time, it may be necessary to restrict access to the website to carry out necessary maintenance work, to keep our website as accurate and up-to-date as possible. We will make every effort to ensure that any downtime or restricted access is kept to a minimum.



SECTION 5 - ORDERING PRODUCTS Please note that the Order Acknowledgement email and order number are not considered as confirmation or acceptance of your order by us. The contract between you and us is completed only when the ordered products are dispatched to you, unless we have previously notified you that we do not accept your order or you have cancelled it. If items are dispatched separately, the acceptance of your order in respect of each item takes place when that item is dispatched. Our carrier will make every reasonable effort to contact you to arrange delivery, but if they are unable to do so, your order will be cancelled and a refund will be issued to your card.

SECTION 6 - PAYMENT METHODS We process the payment from your card as soon as we receive your order and confirm the availability of the products. You can pay using a valid credit or debit card that is accepted by us, and the card's billing address must match your registered address. While placing your order, you can register a new payment card, but once you have completed the checkout process, you cannot change the card associated with that order.

To ensure the safety and security of your payment card, we verify the personal information you provide during the order process against third-party databases. By accepting our Terms and Conditions, you agree to these checks being performed. During these checks, your personal information may be disclosed to a registered Credit Reference Agency to confirm your identity, but no credit checks will be performed, and your credit rating will not be impacted.


SECTION 7 - E-VOUCHERS

An E-Voucher can only be redeemed online at www.simply-hammocks.com and cannot be used at any retail stores or other retailers. Each transaction can only use one E-Voucher.

E-Vouchers can be purchased in decimal amounts between $6.80 and $136.00 and can still be combined with other products in the shopping basket. The E-Voucher is sent via email and contains a voucher code and an expiry date. It can also be personalized with a message. The E-Voucher can be sent directly to the recipient's email address, or the purchaser can email it to themselves and print or forward the email at their leisure.

Once payment has been cleared, the E-Voucher will be transmitted electronically and becomes the responsibility of the purchaser and recipient. Prior to purchase, the purchaser must confirm the recipient's email address. We are not responsible for incorrectly emailed, lost, stolen, or deleted E-Vouchers, although we can assist if you encounter any problems.

From time to time, E-Vouchers may get caught in spam filters, and it is the recipient's responsibility to check these filters. We are not responsible for E-Vouchers that cannot be delivered to the recipient's email address due to spam filters, firewalls, mailbox capacity, or any other factors outside our control.

To redeem an E-Voucher, enter the voucher code provided in the email into the designated box during the checkout process at www.simply-hammocks.com. To use the E-Voucher, you must register with a valid email address on the website. Only one E-Voucher can be used per order, and it can only be redeemed for orders placed in USD at www.simply-hammocks.com.

E-Vouchers cannot be used in conjunction with any third-party benefits, including cashback and loyalty partners. E-Vouchers cannot be used towards promotions with a spend over limit. E-Vouchers are valid for one year from the date shown on the E-Voucher and must be used before that date. Check your E-Voucher to determine when it expires. We offer a refund or exchange (if stock is available) on any unused items with labels and packaging intact within 30 days of dispatch, but E-Vouchers are non-refundable. Faulty items do not require their original packaging. This policy does not affect your statutory rights.

If a refund is required, it must be made through the website following the returns procedure outlined in the returns form that came with your original order. Refunds will be made in the same way as the original payment method (such as onto a gift voucher, debit/credit card account, or a combination of the two). We reserve the right to cancel an E-Voucher at any time.


SECTION 8 - Shipping

We offer delivery services to the United Kingdom and international countries.

For UK mainland deliveries, Simply Hammocks employs courier services to deliver packages between 9:00 am and 5:00 pm from Monday to Friday, excluding bank holidays. On Saturdays, deliveries are made between 9:00 am and 12:00 pm. However, deliveries may be made outside these hours.

If you're not available at home during regular business hours, we suggest arranging delivery to your work address. If we deliver to your home and no one is available, our courier will leave a card with instructions on how to collect your package. If packages remain unclaimed or undelivered, they will eventually be returned to our warehouse.

Simply Hammocks does not recommend leaving instructions for our couriers to leave packages outside your delivery address. If customers choose to use this option, Simply Hammocks will not be held responsible for any loss or damage.


SECTION 9 - Order Cancellations & Returns

You are entitled to cancel or return your order within 14 working days of receiving your goods, as per the Consumer Contracts Regulations. If you decide to cancel your order within this time period, you will receive a full refund, including the original postage and packaging charges, if applicable.

If your order has already been dispatched, please refer to our returns information.

We hope that you are satisfied with your purchase, but if for any reason you wish to return a product, you may do so within 30 days of the despatch date, provided that it is in its original undamaged packaging and in a saleable condition. We will either refund the price or replace the product, but return delivery charges will only be refunded if the item is faulty, damaged, or incorrect. Please note that this does not affect your statutory rights.

Please note that certain products cannot be returned unless they are faulty, including goods made to your specifications and perishable goods.

You must include the return form in your parcel; failing to do so may result in delays or difficulties in processing your refund. If you fail to return your goods to the designated return address, Simply Hammocks cannot be held responsible for any issues or delays in issuing refunds.

Returns outside the 30-day time frame may be accepted at the discretion of Simply Hammocks, and may be refunded as a credit to be used for future online purchases.

The cost of returning items is your responsibility, and you are responsible for any returned goods until they reach our warehouse. We recommend that you obtain a Proof of Postage certificate from the Post Office, which is available free of charge. We will refund postage costs for items that are faulty, damaged, or sent to you in error, but we cannot refund postage costs for items returned from outside of the UK.

If your return parcel is lost by your chosen courier, you must claim compensation from the courier directly, as Simply Hammocks will not be held liable for any lost returns. Please ensure that you choose a suitable returns method with appropriate insurance, and note that unforeseen delays such as strikes, riots, war, or acts of God are beyond our control.

SECTION 10 - Refunds and Exchanges

All refunds for orders cancelled or goods returned will be issued to the original debit or credit card used for the purchase, within 14 days of cancellation or receipt of the returned items. If we are unable to process a refund to your original payment method, a member of our Customer Service team will contact you to arrange an alternate refund method.

If you prefer, you may visit one of our stores to authorize a refund or exchange for an online order by presenting your order confirmation or delivery note. After the 14-day cancellation period, for faulty products, we reserve the right to offer a spare part or repair, or a replacement item of similar or equal value.


SECTION 11 - Promotions & Discounts

To apply a web exclusive or email exclusive promotion or offer to your order, a valid voucher code must be entered into the voucher code box on the basket page. Simply Hammocks is not responsible for not discounting or applying the promotion if a valid code has not been entered. Online voucher codes cannot be used in Simply Hammocks high street retail stores or outlets.

Please note that only one promotion code can be used per order.

If a voucher code or other promotional offer applies to more than one product, the total value of the promotional offer or discount is split and shared across each applicable product in the correct ratio. If an item or part of the order is returned, then the relevant correct value will be refunded.

11.1 Simply Hammocks discount voucher codes (also known as 'Voucher codes' or 'Promotion codes') can only be used for purchases made online at simply-hammocks.com.

11.2 Simply Hammocks voucher codes may be supplied to 3rd party affiliates, via email, catalogue, social media, search or other means of advertisement, and Simply Hammocks reserves the right to limit or change the terms of use of any voucher codes at any time.

11.3 Voucher codes must be entered in the relevant section of the basket at simply-hammocks.com. We cannot apply a discount to orders that have already been placed.

11.4 Voucher codes are typically limited to one use per customer.

11.5 Voucher codes may also be limited to a maximum number of redemptions. If we are unable to accept the discount code you have entered, it may be because the code has expired or the maximum redemption level for the promotion has been exceeded. We will notify you accordingly during the order process, and the discount will not be applied.

11.6 Certain voucher codes and discounts may only be valid on specific spend thresholds, which will be indicated in any promotional communication via email, forum, affiliates or any other marketing collateral. This spend threshold must be met in order to redeem the offer. Simply Hammocks reserves the right to cancel any order that does not meet the required spend threshold.

11.7 Selected voucher codes may be restricted for use against specified products or categories. Whenever possible, we will communicate any restrictions at the point where we promote the voucher code to you.

11.8 Voucher codes cannot be exchanged for a cash alternative or used in conjunction with any other promotions or promotional codes.

11.9 If the voucher code entitles you to a percentage discount, the discount will not be applied to the delivery charge ('delivery' includes additional delivery services, which are charged in conjunction with Simply Hammocks Delivery, for example ‘Next Day Delivery’).

11.10 If the voucher code entitles you to a free delivery offer, this will be for Simply Hammocks standard delivery charge. 'Next Day Delivery' incurs additional delivery charges. Free delivery is not available on our premium Next Day service, and orders over 10Kg will incur an additional service charge.

11.11 Discount voucher codes exclude any Sale/Clearance items unless otherwise stated.

11.12 Voucher codes may be withdrawn or suspended without notice for any reason. We will notify you during the order process if we cannot accept the discount code you have entered.

11.13 Changes to these terms of use may be made at any time.

11.14 Simply Hammocks discount voucher codes are not valid when purchasing E-Vouchers, unless otherwise stated. However, they can be used in conjunction with an E-Voucher to make a purchase on www.simply-hammocks.com.

 

SECTION 12 - Privacy Your registration information and some other data about you are subject to our Privacy Policy. We suggest that you read our Privacy Policy before accepting these Terms and Conditions.

SECTION 13 - Intellectual Property and Copyright The materials and content of the www.simply-hammocks.com website are protected by intellectual property rights, including copyright, trademarks, and database rights. You may only retrieve and display the website's content on a computer screen, store it on a disk for personal, non-commercial use, or print one copy of the content, provided that you maintain all copyright and proprietary notices. Without written consent from Simply Hammocks, you may not modify, reproduce, copy, distribute, or use the materials or content on the website for commercial purposes.

SECTION 14 - Limitations This website and the retail sites, including any software, are provided "AS IS," without any express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

SECTION 15 - Indemnity By using Simply Hammocks's websites, you agree to indemnify and protect Simply Hammocks from any claims, expenses, or liabilities that arise from your submission, posting, or transmission of content or from your misuse of the website, or from the misuse of the website by anyone for whom you are responsible, or from your violation of the Terms and Conditions.


SECTION 16 - WEEE Regulations Since July 1, 2007, the UK's Waste Electrical and Electronic Equipment (WEEE) Directive has been a law in the UK. This law aims to make manufacturers pay for the collection, treatment, and recovery of waste electrical equipment. The regulation also mandates that suppliers of electrical equipment, such as high street shops and internet retailers, must allow customers to return their waste electrical equipment free of charge.

Simply Hammocks fully supports this legislation and offers our customers free take-back of their WEEE items on a like-for-like basis when they buy a new electrical or electronic product from us. Please note that the WEEE item must be returned within 28 days of purchasing the new item.

If you purchase an electrical or electronic item on our website, you are entitled to return your old "like-for-like" item. In this case, please bring proof of your web purchase so that we can dispose of the old item safely.

Under the WEEE Regulations, all new electrical goods must now be marked with the crossed-out wheeled bin symbol shown to the left. The goods are marked with this symbol to indicate that they were manufactured after August 13, 2005, and should be disposed of separately from normal household waste so that they can be recycled.

SECTION 17 - Governing Law The contract between you and Simply Hammocks under which you have made your purchases is agreed to be governed by and interpreted in accordance with the laws of the United States, and any disputes shall be resolved in the United States courts. This does not affect your statutory rights.
